Angela Caballero Cabañas (hereinafter, "EL BALUARTE"), as Data Controller, informs you that, in accordance with the provisions of Regulation (EU) 2016/679, of April 27, (GDPR) and L.O. 3/2018, of December 5, on data protection and guarantee of digital rights (LOPDGDD), we will process your data as reflected in this Privacy Policy.

Important clarification: EL BALUARTE does not directly collect or store your personal data on its own servers. Data collection, reservation management, payments and storage of information is carried out entirely and securely through the external management program and booking engine Avaibook, which strictly complies with European data protection regulations and acts as Data Processor.

3. Purpose of Processing

  • Manage the reservation of your accommodation at El Baluarte de Valderrobres.
  • Billing and collection of the contracted services.
  • Comply with corresponding legal obligations, including the traveler registry required by Citizen Security regulations.
  • Respond to inquiries or information requests sent through our contact channels.

4. Legitimization

The legal basis for the processing of your data is the execution of a contract for the provision of tourist services (your reservation). For the traveler registry, the legitimization is compliance with a legal obligation imposed by the competent authorities. To respond to your inquiries, the legitimization is your express consent.

5. Data Retention

The data provided will be kept as long as the commercial relationship is maintained or for the years necessary to comply with legal obligations (e.g., tax or citizen security regulations). Subsequently, the data will be deleted with appropriate security measures to guarantee its total destruction.

6. Recipients and Data Processors

Your data will not be transferred to third parties unrelated to our activity, except for legal obligation. As mentioned, your data is entered and processed through the Avaibook platform. Subsequently, and by legal imperative, they will be communicated to the State Security Forces and Bodies (Police or Civil Guard) to comply with the traveler registration regulations in tourist accommodations. They may also be communicated to agencies or banking entities exclusively for billing and collection.

7. User Rights

Anyone has the right to obtain confirmation as to whether EL BALUARTE is processing personal data concerning them. Specifically, you can exercise the following rights:

  • Right of Access, Rectification and Deletion.
  • Right to the Limitation of processing.
  • Right to the Opposition of processing.
  • Right to the Portability of your data.

To exercise these rights, you can send an email to baluartevalderrobres@gmail.com, attaching a copy of your ID or equivalent document to identify yourself. You also have the right to file a claim with the Spanish Data Protection Agency (AEPD) if you consider that the processing does not comply with current regulations.
